TERMS AND CONDITIONS

1) Acceptance of the general conditions of sale

The purpose of these general conditions of sale is to define the obligations and duties between the website www.chateaupierron.com and its customers. These general conditions of sale are automatically accessible to users from the website homepage. Before placing an order, these general conditions of sale are presented to the user who undertakes to read them in their entirety and to subscribe to them if they wish to continue their order.

 

Therefore, the customer acknowledges accepting the entirety of these provisions without reserve, in exchange for which the website www.chateau.pierron.com also commits to respecting its obligations under these general conditions of sale. Since any order implies acceptance of these conditions, the customer can only challenge the order within the limits provided for in section 9 - refund and cancellation policy.

 

A customer is understood to be any person wishing to buy on the website www.chateau.pierron.com, being aged eighteen (18) years or over and having accepted these general conditions of sale.

 

These general conditions of sale may be modified by the website www.chateau.pierron.com without warning. Customers are therefore invited to consult the general conditions of sale regularly during visits to the website and to agree to the general conditions of sale before confirming each order.

 

2) Abuse of alcohol and protection of minors

Alcohol abuse is dangerous for your health, consume with moderation

In application of article L.3342-1 of the public health code forbidding the sale of alcohol to minors under eighteen (18), customers undertake, by confirming the order, that they are at least eighteen at the time of placing the order.

 

3) Prices

Unless otherwise stated, the prices displayed on the website www.chateaupierron.com are expressed in euros including all taxes, and excluding participation in shipping, transport and handling costs from the premises of the www.chateaupierron.com website. These prices include value added tax at a rate of 20% and French duties.

 

The website www.chateaupierron.com reserves the right to modify prices at any time. However, the prices displayed in an order after validation are firm and final.

 

The prices indicated on the website www.chateaupierron.com are given subject to any typographical errors. In such a case, the website www.chateaupierron.com will contact the customer to point out the error and send a corrected invoice. In case of typographical errors, the customer is free to accept the corrected prices or to cancel the order. In case of cancellation of an order, the customer will be reimbursed no later than seven (7) days as from the date on which the customer gives notice of the cancellation. The website www.chateaupierron.com cannot be held liable for this deadline being exceeded for reasons beyond its control.

 

In the event of a difference in price between different pages of the website, only the price indicated on the detailed product description sheet will be valid.

 

Discounts and other promotional offers cannot be combined and are limited to one per household (same name, same address) and per year. The website www.chateaupierron.com reserves the right to refuse or cancel any order that does not satisfy this provision.

 

4) Presentation of the products

Detailed presentations of the products on sale on the website www.chateaupierron.com  are displayed on the website. Their reproduction in whole or in part is not authorised, for reasons of intellectual property. Product photos presented on the website are not contractual.

 

5) Order

Only people legally capable of entering into contracts for the goods and services offered on the website www.chateaupierron.com may place orders. In application of L.3342-1 of the public health code, minors under eighteen (18) are not authorised to place orders on the website www.chateaupierron.com.

When placing orders, customers agree to give the information required and to attest to its truth.

In addition, the customer undertakes to verify that the information entered (in particular invoicing and delivery addresses, quantity and nature of the products ordered, amount of the order) do not contain any errors; such errors cannot be attributed to the website www.chateaupierron.com and cannot give rise to claims or cancellation of orders at the request of the customer.

 

The website www.chateaupierron.com undertakes to process any order within the limits of available stocks and cannot be held liable for failure to fulfil the contract with the customer in case of unavailability of the product(s), products being out of stock, in case of force majeure, disruption or strikes in transport or communication services, or any other unforeseeable event beyond the control of the parties.

 

The website www.chateaupierron.com will not be held liable in case of unavailability of a product ordered. However, the website www.chateaupierron.com undertakes to inform the customer as soon as possible and to offer an equivalent replacement product, or a refund within seven (7) days from the date on which the customer is informed.  The website www.chateaupierron.com cannot be held liable for this deadline being exceeded for reasons beyond its control.

 

The website www.chateaupierron.com reserves the right to refuse and cancel any order issued by a customer with a payment in dispute from a previous order.

 

In accordance with the provisions of law No. 80 336 of 1 May 1980 relative to the transfer of ownership, the website www.chateaupierron.com remains owner of the products sold until complete payment of the order by the customer. The customer becomes responsible for the products on their delivery. The transfer of ownership thus implies acceptance by the customer of the transfer of risk.

 

6) Payment

Any order placed by the customer is considered firm and final once full payment is made.

Any order placed must be paid for on presentation of the purchase order to the customer during the online purchase process. In order to pay for orders on the website www.chateaupierron.com the customer must hold a credit card. (Carte bleue, Visa, Eurocard, Mastercard).

Debit is immediate once the customer's order is paid for on the website of our partner Paypal.

When paying by credit card, customers certify that they have full authorisation to use the credit card and have sufficient funds to pay for the order in the bank account attached to the credit card used for payment.

The secured credit card payment services is provided by Paypal.

 

To pay for the order, the customer is required to provide a name, credit card number, expiry date and the corresponding security code.

No bank information that the customer is required to communicate to the website www.chateaupierron.com is either stored or visible on the Internet. Similarly, the bank information is neither stored nor visible on the servers of the website www.chateaupierron.com. Given this fact, customers are required to re-enter bank information on placing each order.

 

 7) Legal guarantee

In consideration of article 1641 of the civil code, the website www.chateaupierron.com guarantees the product sold against hidden defects that make it unfit for the use for which it is intended, or which diminish so much this use that the buyer would not have acquired it, or would have paid a lower price, had they been known.

Under this clause, the customer has six months to report a hidden defect in writing (by email or post) to the website www.chateaupierron.com, which will then contact the customer to arrange return of the allegedly defective products by a transporter for expert assessment at no cost to the client.

 

After expert assessment, and in case of defect found by the website www.chateaupierron.com, the customer will receive a full refund for the amount of the products proven to be defective.

 

8) Legislation

These general conditions of sale are subject to the application of French law.

In case of dispute, the customer is invited to come to an amicable agreement by contacting customer services at the website www.chateaupierron.com.

 

CONFIDENTIALITY

In accordance with law No. 78-17 on data files and liberties of 6 January 1978, customer have the right to access, modify, correct and remove personal data concerning them by writing, by post and justifying their identity, to the following address: SC DU CHATEAU PIERRON - Route de Mézin - 47600 NERAC.

 

The information provided to the website www.chateaupierron.com is necessary for the correct performance of the contract between the parties. This information remains confidential.

 

REFUND / CANCELLATION POLICY

In application of article L.121-16 of the consumer code, the customer has the right to a cooling-off period of seven (7) clear days from receipt of the products ordered (as shown on the transporter's delivery note) on the website www.chateaupierron.com, without having to provide a reason or pay penalties except for return costs that remain at the customer's charge. . If the period of seven (7) clear days expires on a Sunday or public holiday, the period is extended until the next business day.

 

In the case of ordered products returned by the customer during the cooling-off period, two solutions are possible:

 

Customers can return the products to the website www.chateaupierron.com using the transporter of their choice.

 

Customers can have the products collected by the website www.chateaupierron.com. This collection will be by a transporter appointed by the website www.chateaupierron.com at a cost of twenty-five (25) euros including all taxes. Collection will take place after payment of the return cost to the website www.chateaupierron.com.

 

The website www.chateaupierron.com undertakes to refund customers exercising their rights under the cooling-off period no later than seven (7) days after they have exercised this right. The website www.chateaupierron.com cannot be held liable for this deadline being exceeded for reasons beyond its control. The customer will be refunded by cheque.

 

Products returned by the customer must be in their original state (unopened bottles, undamaged corks and labels) with their original packaging and original invoice.

 

The risks to products when returning them to the website www.chateaupierron.com are assumed by the customer.

 

DELIVERY TERMS AND CHARGES

Unless otherwise indicated, delivery charges are always at the customer's cost and calculated as follows:

Products sold singly: Delivery charges included in the sale price

from 6 to 24 bottles ordered: €25

from 30 to 54 bottles ordered: €20

As from 60 bottles: free delivery

 

The website www.chateaupierron.com only delivers products to mainland France. No delivery is possible outside this geographical area. Collection of orders at the property is possible.

 

Shipping of products order by the customer takes place after placing the order, full payment, validation by us and preparation. Shipping of the order usually takes place within 96 hours of the order being placed by the customer.

 

Products ordered by the customer are shipped to the delivery address given in the order. In case of delivery made impossible due to one or more errors in the delivery address entered by the customer, the re-delivery costs will be borne by the latter who cannot make a claim for late delivery.

 

In case of an invalid delivery address or delivery made impossible due to incorrect data given by the customer, the order will be returned to the warehouse of the website www.chateaupierron.com  by the transporter. The customer can then request re-delivery of the order or cancel it and request a refund excluding transport costs. Re-delivery of the order will only take place after the customer has paid the re-delivery charges.

 

Products are always transported at the customer's risk. On delivery of the products, it is the responsibility of the customer or their representative to check to condition of the package(s). Similarly, the customer must ensure the compliance of the products delivered.

 

Any damage, non compliance or shortfall on delivery must be notified by the client in detail and in writing on the delivery note and accompanied by the signature of the customer or their representative. The website www.chateaupierron.com cannot meet claims from customers in the absence of notification in detail and in writing on the delivery note and accompanied by the signature of the customer or their representative.

 

If the customer decides to refuse the package because of an anomaly or non compliance, the customer must indicate this on the transporter's bill of lading and send it to the following address: SC DU CHATEAU PIERRON - Route de Mézin - 47600 NERAC.

 

Any claim relating to delivery that falls outside the provisions of this section cannot be attributed to the website www.chateau.pierron.com.

 

Products are delivered to the customer in packaging boxes of six (6) bottles or singly in the case of Flocs, Armagnacs and Magnums.

 

The delivery of the products ordered is made to the customer provided that the information regarding the delivery address and access to the delivery address (door code, building number, etc...) were provided in full and without error by the customer to the website www.chateaupierron.com. Similarly, access conditions to the delivery address must allow the transporter to make the delivery.

 

Deliveries are made by a transporter appointed by the website www.chateaupierron.com, from Monday to Friday (excluding public holidays).

 

Each order is individual. Placing several consecutive orders does not have the effect of merging these orders. According to the amount of the orders, it is therefore possible that the customer will have to pay delivery charges several times.
